How often can I file a Chapter 7 bankruptcy?
You can file a Chapter 7 bankruptcy every 8 years from the last date you filed. If you have already filed a Chapter 7 within that time period, we would suggest that you come in for a free consultation to find out what other options you may have for your particular financial situation.

If I am married or in a civil union, do both of us have to file for Chapter 7?
Either party can file without the other party, individually. It is, however, more economical for both parties to file at the same time, should they choose to do so.

If I file Bankruptcy, will I lose everything?

All or most of your property will be exempt. You will not lose anything you do not want to give up, which may include you home, car, furniture, pensions, etc.

Are all debts dischargeable?
Some debts are not affected by bankruptcy. You may still be responsible for payments after the bankruptcy is complete. These debts include: sales, payroll and withholding taxes - Income taxes less than 3 years old - student loans - child support and alimony payments - Intentional wrongs - damages caused by drunk driving - fraud - criminal court fines

Can I continue to use my credit cards?
All debts incurred 90 days prior to filing a bankruptcy, you could be held responsible for. All charge activity needs to cease prior to that time. This includes credit card charges, cash advances, pay day loans, etc.

Should I continue to pay my creditors?
If you qualify for bankruptcy, you can cease making payments to credit cards, personal loans, medical bills, etc. These debts will be discharged in the bankruptcy. Once the bankruptcy is filed, you would need to continue making monthly payments on your secured debts (house, vehicles, etc).

What if I am being harassed by my creditors?
As soon as we put your petition on file you are protected by an Automatic Stay by the Federal Court. This means that no creditor can take any more action against you to collect debt. This Federal injunction stops creditors from all harassment including phone calls, lawsuits, garnishments, repossession threats, etc.
